Established in soil or 'soil-less' growing medium?

I recently found out selling/shipping plants in soil is a no-no for lots of states. Arkansas is one. I can find at least an approximation of a complete list next time I'm near a Fedco catalog. They have states they can't ship certain trees to because they are in soil.

I have questions about it springing back. It's an older tree, and was cut at just the wrong time.
