So trademark infringement depends on the likelihood ofconfusionn wrt the source of the goods (who sold the goods) They consider various factors but my fav factor for noninfringement here is the degree of purchaser care. Anyone dropping $400 on a CLOCK (i mean wtf, seriously?) is bound to exercise more care than making a regular purchase.
