The defendant would (want to) participate to (1) not look bad and guilty, and (2) To avoid being sentenced in absentia where the plaintiff gets the requested verdict. 

Like in regular court cases, the defendant could later request a retrial, but only after convincing a small jury with a good reason for not responding earlier.
