Whether or not he can do it will totally depend on whether or not he gets away with it.  It opens up a whole host of issues (including federal law supremacy).  It will likely be faught in court.  If he had done this too soon, it wouldn't have worked at all,  he is trying things, seeing if they stick, and the escalating.  It's easy to monday morning quarterback him, but he is trying and doing far more than most.
