Trucking companies do it all the time. The only time you can really get in trouble doing it is when the terms of your contract are similar to those of an employment contract, for example paying by the hour or requiring a set number of hours of work and things like that, basically if it's obvious youre creating an employment contract but not calling it that to avoid labor law.
