 If you want a glass half full take we have Nostr and the ruling seems to be focused on that they didn’t have standing to sue, not as much on the underlying issue itself. Someone or group who could demonstrate harm could still bring another similar case.

 left it open to people with standing, but it still shouldn't be illegal until you get caught by someone has standing. so I guess it's only illegal when caught not the actual activity
