If I understand correctly, the argument isn't as simple as "code is speech", but "writing code is speech" right? Executing code would be taking action and fortunately the developers only write code and any and all execution of the code was lawful.

Like making a knife and testing it to cut meat, fruit, but then a consumer 4 years later uses it to kill people.
