Is MEV wire fraud now?

Or is it counter-MEV that's wire fraud?

What the hell is wire fraud other than a catch-all charge for doing something the authorities dislike via the internet? 

 What about counter counter MEV? 

 Whats MEV? 

 Maximal Extractable Value. It's used by validators in ETH to build blocks so that they get the most fees (rewards) possible.

 But the law is super clear.
