Ample evidence of those actions were presented at trial even though the prosecution decided not to formally pursue those charges. They were true, and the evidence was sufficient to compel the judge to give him life. And they were a deciding factor in the appeals court rejecting his appeal. You can't just pick and choose based on what you wish was true.
