US calls India among most challenging on IPR safety

The US Trade Representative has called India among the most challenging major economies on enforcement and protection of intellectual property rights (IPR) and retained it on Priority Watch along with China, Indonesia, Russia, Chile, and Venezuela. The report lists several concerns regarding India's intellectual property rights regime, including counterfeit medicines, auto parts, and online piracy. The US authorities have divergent views on several aspects of India's intellectual property rights regime, particularly the granting of patents for medicines. The 2024 USTR Special 301 Report acknowledges the progress made by India on certain issues, such as the establishment of specialized IP enforcement units and courts. However, it also highlights inadequate IP enforcement, high rates of online piracy, trademark opposition backlog, and insufficient legal means to protect trade secrets. India, Singapore, and China were among the top countries of origin for counterfeit pharmaceuticals seized at the US border in fiscal year 2023. The report also mentions the global scale of trademark counterfeiting, involving the production, transshipment, and sale of various fake goods from China, India, and other source countries.
